Welcome to The Lab Fitness thank you for choosing us to support you in your wellbeing and physical training journey. Through our mix of online classes, one-on-one sessions and educational webinars, all delivered online, we hope you will get all the tools to improve your ability to accomplish your training goals faster, safer, in balance with the rest of your life and with maximum benefits to your overall health and wellbeing.
Our Online Classes, one-to-one sessions, webinars, workshops and any content produced and published by The Lab Fitness (together, the ‘Services’) are available to you exclusively online.
In order to maximise progress, it is important to follow programme guidelines during supervised and (if applicable) unsupervised training days. Exercise, healthy eating, and a healthy lifestyle are all equally important in your journey to a better you.
Before getting started, please read the Service Agreement Terms and Conditions (the ‘Terms’) outlined below. Please read these Terms carefully before you start to use our Services. If you do not agree to these Terms, you must not use our Services.
The Terms apply whether you are a user that registers an account with us, unregistered user or visitor to the www.thelabfitness.co.uk (the ‘Site’). You agree that by subscribing or otherwise registering, downloading, accessing or using our Services, you are entering into a legally binding agreement between you and us regarding your use of the Services.
By using our Services, you are agreeing:

That you have read and understood our Privacy Policy which sets out how we collect, process and use your data;

To our Medical Disclaimer when you participate in any of our online classes
GENERAL

You agree that you are at least 18 years old at the time you access and/or use our Services.

In order to access online classes, one-on-one sessions, webinars, workshops you will need to create a customer account with us.

We reserve the right to change these Terms at our sole discretion, and the latest version will appear on the “Site“ stating the date last updated. By using the Service after any changes have been posted, you agree to the new terms.
THE SERVICES
A) Online Exercise Classes

By purchasing a ‘Drop In Class’ you are entitled to book onto any Online Class shown on the Online Class timetable.

A 10 Classes Plan entitles you to attend any one of the Online Classes shown on the Online Class timetable. The 10 Classes Plan is valid for a year after the date of sale. Any unused classes past the expiration date will be void.

A True Unlimited Class Subscription Plan entitles you to book onto any of the Online Classes shown on the Online Class Timetable timetable for 1 month from the date of sale. The 1 Month True Unlimited Class Plan is a contract and automatically renews 1 month after the date of sale. You can cancel your subscription any time, provided you give one month notice. See Cancellation Policy for further details
B) One2One Sessions

By purchasing 5 One2One Sessions you are entitled to 5 hours of Online Only Personal Training sessions that must be booked within 3 months of the plan purchase date. The 5 One2One Sessions Plan is valid for 3 months of the date of purchase. Any unused sessions thereafter will be void.

By purchasing 10 One2One Sessions you are entitled to 10 hours of Online Only Personal Training sessions that must be booked within 3 months of the plan purchase date. The 10 One2One Sessions Plan is valid for 3 months of the date of purchase. Any unused sessions thereafter will be void.
USE OF OUR SERVICES
Unless otherwise indicated, all content, information and other materials on our Services, including our logos, the visual interfaces, graphics, design, information, services, text, images, sound files and any other files (the “Content“) are protected by relevant intellectual property rights and laws. All Content contained on our Services is the property of The Lab Fitness and/or third party licensors.

You must be over the age of 18 to access and book our Services

You may not transfer, assign or lend purchased Services to anyone else. These are exclusive to you.

You must complete a Physical Activity Readiness Questionnaire (ParQ) before you book on to any of the One2One Personal Training sessions, be that online or in person. At The Lab the safety of our customers is utmost priority. We use the ParQ to assess your readiness to take part in physical and aerobic activity based on your health history, current symptoms and risk factors.

By purchasing and participating in any of our Services you agree to our Medical Disclaimer. If in doubt, it is your sole responsibility to consult a medical professional.

You agree that when you create an account with us, you shall take all necessary steps to protect your login details and keep them secret. You agree that you shall not give your login details to anyone else or allow anyone else to use your login details or account. If you do not keep your login details secret, or if you share your account or details with someone else, you accept full responsibility for the consequences of this (including any unauthorised purchases).

You warrant that all the information you provide to us on accessing and/or using our Services is and shall remain true, correct and accurate at all times.

You agree that you will not:
7.1. Impersonate any other person, conduct yourself in an offensive or abusive manner, or use our Services for any unlawful purposes
7.2. Use the Services for any commercial or business purpose or the benefit of any third party;
7.3. Use virtual private networks, false email addresses or any other means to mask your identity;
7.4. Collect, harvest or ‘scrape’ any data from any web pages contained in our Site;
7.5. Interfere with another user’s use and enjoyment of the Site or the Services
7.6. Use our Services in any other way not permitted by these Terms.
7.7. You may not sell, license, distribute, copy, modify or otherwise make any derivative use of, publicly perform or display, transmit, publish, edit or adapt the Content.
7.8. You must comply with the laws that apply to you in the location that you access our Services from. If any laws applicable to you restrict or prohibit you from using our Services, you must comply with those legal restrictions or, if applicable, stop accessing and/or using our Services.
7.9. We may suspend, restrict or terminate your account and your access to our Services with or without notice if we believe that you have breached these Terms.
MEDICAL DISCLAIMER

As part of our Services you will have access to health, fitness and wellbeing information and will be able to participate in live or video-on-demand classes, activities and any other products and/or services which are provided by The Lab Fitness or Third Parties. You acknowledge that such information and the Sessions are designed for educational and entertainment purposes only and you should not rely on this information as a substitute for, nor does it replace, professional medical advice or treatment. The use of any information provided on our Services is solely at your own risk. For more information please refer to our Medical Disclaimer.

You acknowledge that some of the Sessions may be physically demanding and you understand that it is your responsibility to consult with your doctor prior to participating in the Sessions to ensure that you are fit and well enough to take part and that your participation in the Sessions will not pose any unusual or serious risks to your health and well-being. By accessing our Services and taking part in any of the Sessions you warrant and represent that you are fit and healthy to take part in the Sessions.

You hereby waive, release, covenant not to claim, and discharge us from any and all claims arising out of your participation in any of the Sessions.
PAYMENTS AND REFUNDS

As our services are online we are not able to accept cash payments.

All services must be paid for in advance via the online booking system before you can access them or any other related content.

All package services are cleared at the stated expiration date. Any unused sessions cannot be carried over or refunded.

The monthly payment for True Unlimited Package is by card via the online booking system and is due immediately. Your card will be debited as soon as you complete the payment booking system online and are non-refundable under any circumstances.

All fees and charges are subject to periodic increases and we reserve the right to change the costs of our services at any point.

All service payments are final and nonrefundable.

If you cancel your True Unlimited monthly payment or your account is terminated due to arrears, you will not be refunded for any unused sessions.

All purchased services are non-transferable
CANCELLATION POLICY
A) Cancellations by customers

One2One sessions and Group Exercise Classes booked must be cancelled no less than 24 hours before the classes advised start time or agreed session start with with your personal trainer/coach

Any One2One session or Group Exercise Class cancelled with less than 24 hours’ notice will be charged to the client. No refunds will be issued.

Sessions cancelled with over 24 hours notice can be used again within the agreed contracted period for the contracted services.

To cancel a monthly True Unlimited Package you must give us one full calendar month notice. A cancellation request must be made in writing - email us at hello@thelabfitness.co.uk and let us know you would like to stop your monthly payments
B) Cancellation by us

We may cancel, suspend or limit your account and access to our services without notice if you commit a material breach of this agreement including

We may restrict your access to our services without notice if you continually fail to cancel classes within the required time limit.

We may cancel your account or restrict access without notice if any fees or charges remain unpaid 14 days after the due date.

We reserve the right to cancel any Group Exercise class or a Personal Training Session if an instructor is unable to attend a session due to unavoidable circumstances.
DATA COLLECTION

We may collect certain personal information from you including personal details, financial details and details about your health. We will use this information for managing your subscription, being able to communicate with you and update you. You can opt out of such communications by getting in touch with us or unsubscribe from marketing emails directly.

We will not share your personal information with third parties. Its use will be limited to management and employees of this company.

There may be occasions where we would record videos of our online classes, webinars and personal training sessions, which may include you. You will be notified if such an event happens during the session you are participating in and you will be given the option to opt out at times when recording is in progress. We will use that content for press and other promotional uses.
YOUR COMMITMENT TO US

You should always exercise in a safe manner and to your own abilities.

If you are concerned or know that you may have a medical condition that may affect your training you should seek medical advice prior to purchasing one of our exercise services

You should not undertake any exercises that you have been told are not suitable for you.

You complete a ParQ in advance of your first One2One Session

Being prepared for your session. To get the most out of your session we recommend the following:

Wear appropriate clothing and footwear. Clothes should be clean, comfortable non restrictive workout attire, and footwear supportive and functional.

Have a small snack or light meal two or three hours before your session

Be sure you are well hydrated and avoid alcohol prior to training

If you are feeling unwell before your session please do not attend the session. Your wellbeing comes first.
